BD Bites Driver Terms & Conditions

1. Agreement

By registering as a BD Bites driver, you agree to these Terms & Conditions. These terms govern your relationship with BD Bites and apply whenever you undertake deliveries through the platform.

Drivers operate as independent self-employed contractors and are not employees, workers, agents or partners of BD Bites.

2. Eligibility

To deliver using BD Bites, you must:

  • Be at least 18 years of age.
  • Have the legal right to work in the United Kingdom.
  • Hold any licences required to operate your chosen vehicle.
  • Maintain valid Hire & Reward insurance where required.
  • Comply with all applicable UK laws and regulations.

Providing false information may result in immediate removal from the platform.

3. Independent Contractor Status

Drivers are responsible for:

  • Their own tax and National Insurance obligations.
  • Maintaining their own vehicle.
  • Fuel and vehicle running costs.
  • Insurance.
  • Equipment required to complete deliveries.

Nothing within these Terms creates an employment relationship.

4. Insurance

Drivers must maintain valid insurance appropriate for the vehicle used, including Hire & Reward insurance where legally required.

Failure to maintain valid insurance may result in immediate suspension or permanent removal.

Drivers are solely responsible for ensuring their insurance remains valid at all times.

5. Right to Work

Drivers must ensure they remain legally entitled to work within the United Kingdom.

BD Bites may request updated evidence at any time.

6. Vehicle Requirements

Drivers must ensure their vehicle is:

  • Safe and roadworthy.
  • Properly taxed.
  • MOT compliant where applicable.
  • Maintained to legal standards.

BD Bites accepts no responsibility for vehicle maintenance or associated costs.

7. Accepting Deliveries

Drivers are free to choose whether to accept delivery requests.

Once a delivery has been accepted, drivers agree to:

  • Complete the delivery promptly.
  • Follow customer delivery instructions where reasonable.
  • Handle food carefully.
  • Deliver to the correct address.

Repeated cancellations after acceptance may result in account review.

8. Professional Conduct

Drivers must:

  • Treat customers, restaurants and staff respectfully.
  • Behave professionally.
  • Not use abusive, threatening or discriminatory language.
  • Not consume alcohol or illegal drugs while delivering.
  • Never operate a vehicle whilst impaired.

BD Bites reserves the right to suspend drivers for inappropriate conduct.

9. Food Safety

Drivers agree to:

  • Use suitable insulated delivery bags where required.
  • Transport food carefully.
  • Avoid unnecessary delays.
  • Never tamper with customer orders.

Tampering with food may result in permanent removal and referral to the appropriate authorities.

10. Payments

Driver earnings will be paid in accordance with BD Bites' payment schedule.

Drivers are responsible for ensuring their bank details remain accurate.

BD Bites reserves the right to withhold payments where fraud or serious breaches are suspected pending investigation.

11. Customer Property

Drivers must take reasonable care of all customer orders.

Drivers must not intentionally damage, consume or misuse customer property.

12. Privacy

Drivers must treat all customer information as confidential.

Customer addresses, telephone numbers and personal information must only be used for completing deliveries.

Drivers must not:

  • Contact customers after delivery.
  • Store customer information.
  • Share customer information with third parties.

13. Fraud

The following are strictly prohibited:

  • Creating fake deliveries.
  • Attempting to manipulate payments.
  • Sharing driver accounts.
  • Allowing another person to use your account.
  • Providing false documentation.

Any fraudulent activity may result in permanent removal and legal action.

14. Health & Safety

Drivers remain responsible for their own safety while working.

Drivers should never place themselves in danger to complete a delivery.

BD Bites encourages drivers to comply with all road traffic laws.

15. Equipment

Drivers are responsible for providing and maintaining any equipment required to complete deliveries, including:

  • Mobile phone
  • Data connection
  • Vehicle
  • Charging equipment
  • Delivery bag (where applicable)

16. Account Suspension

BD Bites may suspend or permanently deactivate accounts where drivers:

  • Breach these Terms.
  • Provide false information.
  • Lose the legal right to work.
  • Fail to maintain insurance.
  • Commit fraud.
  • Receive repeated serious customer complaints.
  • Behave in a manner likely to damage the reputation of BD Bites.

17. Limitation of Liability

BD Bites is a technology platform connecting customers, restaurants and independent delivery drivers.

To the maximum extent permitted by law, BD Bites shall not be liable for indirect or consequential losses arising from the use of the platform.

Nothing within these Terms limits liability that cannot legally be excluded under UK law.

18. Changes to these Terms

BD Bites may amend these Terms from time to time.

Drivers will be notified of material changes through the platform or via email.

Continued use of the platform constitutes acceptance of the updated Terms.

19. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
